These Terms & Conditions ("Terms") govern your use of The Schultz Agency's website (theschultzagency.com) and the professional services we provide, including insurance advisory, mortgage consulting, and Bnancial planning. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Acceptance of Terms


These Terms constitute a legally binding agreement between you SA THE SCHULTZ AGENCY INSURANCE · MORTGAGE · ADVISORY · WASHINGTON STATE LEGAL DOCUMENTATION Terms & Conditions Effective Date: April 6, 2026 · Last Updated: April 6, 2026 ("Client," "you," or "your") and The Schultz Agency, operated by Tony Schultz, an independent insurance producer and mortgage advisor licensed in Washington State ("Agency," "we," "us," or "our").

We reserve the right to update these Terms at any time. Changes become eAective when posted to this page with an updated "Last Updated" date. Your continued use of our services aFer that date constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

The Schultz Agency provides independent advisory services across three primary practice areas:

Licensing & Regulatory Disclosures


Insurance

The Schultz Agency operates as an independent insurance producer licensed in Washington State. We are appointed with multiple carriers including Safeco, Progressive, and Travelers, among others. Our compensation may include commissions paid by insurance carriers. We will disclose the nature of our compensation upon request.

Mortgage

Mortgage advisory and loan origination services are conducted through C2 Financial Corporation, a licensed mortgage broker operating in Washington State and other states. Tony Schultz is a licensed mortgage loan originator (MLO). All mortgage disclosures required by the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and applicable state law will be provided during the application process.

Financial Planning

Financial planning, retirement income analysis, and annuity recommendations are provided in our capacity as a licensed insurance professional. We are not registered as an investment adviser with the SEC or Washington State. Information provided does not constitute investment advice within the meaning of the Investment Advisers Act of 1940. For securities-based advice, we recommend consulting a registered investment adviser.

Nothing on this website or in our communications constitutes an o2er to sell or a solicitation to buy any security. Past performance is not indicative of future results. All financial strategies involve risk.

Client Conduct & Responsibilities


By engaging our services, you agree to:

  • Provide accurate, complete, and truthful information in connection with insurance applications, mortgage applications, and Wnancial planning discussions. Providing false or misleading information may constitute fraud and could void coverage, result in loan denial, or create legal liability.
  • Promptly notify us of any material changes to your circumstances (address changes, new drivers, property improvements, employment changes, etc.) that may aAect your insurance or mortgage.
  • Review all documents, proposals, and policy materials provided to you and ask questions before signing.
  • Not use our website for any unlawful purpose, to transmit harmful content, or to attempt unauthorized access to our systems.
  • Maintain the conWdentiality of any login credentials or portal access we provide.

Important Disclosures


No Guarantee of Coverage or Approval

Quotes, proposals, and recommendations provided by The Schultz Agency are subject to underwriting review and approval by the applicable carrier or lender. We do not guarantee the issuance of any insurance policy or the approval of any mortgage application.

Information is Not Legal or Tax Advice

Information we provide regarding asset protection, retirement accounts, tax treatment of annuities, and related topics is general in nature and for educational purposes only. It does not constitute legal or tax advice. You should consult a qualiWed attorney or CPA for advice speciWc to your situation.

Carrier & Lender Relationships

As an independent agent, we represent your interests, but we are also appointed by and work with insurance carriers and lending institutions. In the event of any con\ict, we will disclose it promptly and work to serve your best interests.

Third-Party Websites

Our website may link to third-party websites (carrier portals, lender sites, regulatory resources). We are not responsible for the content, privacy practices, or accuracy of third-party sites. Visiting linked sites is at your own risk.

Limitation of Liability & Disclaimers

Disclaimer of Warranties

Our website and its content are provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, Wtness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or harmful components.

Limitation of Liability

To the maximum extent permitted by Washington State law, The Schultz Agency, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to loss of income, loss of proWts, or loss of data, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for any claim arising from our services shall not exceed the total fees paid by you to The Schultz Agency in the twelve (12) months preceding the claim, or $1,000, whichever is greater.

Nothing in these Terms limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

Errors & Omissions

We carry Errors & Omissions (E&O) insurance as required for licensed insurance producers in Washington State. If you believe we have made a professional error, please contact us promptly so we can address the matter.


SECTION 7

Intellectual Property


All content on our website and in materials we create — including but not limited to text, graphics, logos, branded reports, mortgage comparison analyses, and Wnancial planning documents bearing The Schultz Agency name — is the property of The Schultz Agency and is protected by applicable copyright and trademark law.

Client-speciWc reports and analyses we prepare for you are provided for your personal use. You may not reproduce, redistribute, or publish them without our written consent. General website content may be shared for personal, non-commercial purposes with attribution.

The Schultz Agency name, logo, and shield mark are proprietary. Nothing in these Terms grants you any right to use them.


SECTION 8

Privacy


Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of information as described in the Privacy Policy.


SECTION 9

Governing Law & Dispute Resolution


Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its con\ict of law principles.

Informal Resolution

Before initiating any formal dispute, you agree to contact us Wrst and give us a reasonable opportunity (not less than 30 days) to resolve the matter informally.

Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our services that cannot be resolved informally shall be settled by binding arbitration administered in King County, Washington, under the rules of the American Arbitration Association (AAA) or JAMS, at our mutual election. The arbitrator's decision shall be Wnal and may be entered as a judgment in any court of competent jurisdiction.

You and The Schultz Agency each waive any right to a jury trial and agree that arbitration shall be conducted on an individual basis and not as a class action.

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and eAect.


SECTION 10

Termination


Either party may terminate a service relationship with reasonable notice. We reserve the right to terminate or suspend your access to our website or services immediately, without prior notice, if you breach these Terms or if we are required to do so by law or regulatory authority.

Upon termination, provisions of these Terms that by their nature should survive (including Sections 6, 7, and 9) will continue to apply.


SECTION 11

Entire Agreement


These Terms, together with our Privacy Policy and any service-speciWc agreements executed between you and The Schultz Agency (such as a signed client engagement agreement or mortgage application disclosures), constitute the entire agreement between you and us regarding your use of our services and supersede all prior communications, representations, or agreements.
